1. Acceptance of Terms

By accessing or using the Empower LO website, platform, or any of our services, you agree to be bound by these Terms of Service. If you don't agree with any part of these terms, please don't use our services.

These terms apply to all users of our platform, including individual loan officers, team administrators, and anyone accessing our website.

2. Our Services

Empower LO provides a mortgage marketing and CRM platform built on HighLevel (GoHighLevel). Our services include but are not limited to:

• CRM and pipeline management tools
• Marketing automation and campaign workflows
• AI-powered conversation tools
• Website and funnel building
• Onboarding, setup, and ongoing support

We may modify, add, or discontinue features at any time. We'll make reasonable efforts to notify you of significant changes.

3. Accounts & Registration

To use our platform, you'll need to create an account. When you do, you agree to:

• Provide accurate and complete information
• Keep your login credentials secure
• Notify us promptly if you suspect unauthorized access to your account
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these terms or are inactive for an extended period.

4. Acceptable Use

You agree to use our platform lawfully and responsibly. You may not:

• Violate any applicable laws or regulations (including mortgage industry regulations like TCPA, CAN-SPAM, and state licensing requirements)
• Send spam or unsolicited communications through the platform
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Resell, redistribute, or sublicense access to the platform without our written permission
• Use the platform in any way that could damage, disable, or impair our services

You are responsible for ensuring your use of the platform complies with all applicable laws, including mortgage advertising and communication regulations in your jurisdiction.

5. Billing & Payments

By subscribing to a paid plan, you agree to pay the fees associated with your selected plan. Here's how billing works:

• Subscriptions are billed on a recurring basis (monthly or annually, depending on your plan)
• Payment is due at the start of each billing cycle
• We use third-party payment processors (such as Stripe) to handle transactions securely
• Prices may change with at least 30 days' notice before your next billing cycle
• You are responsible for any applicable taxes

If a payment fails, we may retry the charge or suspend your account until the balance is resolved.

6. Cancellation & Refunds

You can cancel your subscription at any time. Here's what to know:

• Cancellations take effect at the end of your current billing period — you'll retain access until then
• We do not provide prorated refunds for partial billing periods
• Setup fees and one-time charges are non-refundable once the work has been delivered
• If you believe you've been charged in error, contact us at support@empowerlo.com and we'll make it right

7. Your Content & Data

You retain ownership of any content, data, or materials you upload to the platform ("Your Content"). By using our services, you grant us a limited license to host, store, and process Your Content solely to provide the services.

You are responsible for:

• Ensuring you have the rights to use and upload Your Content
• Maintaining your own backups of important data
• The accuracy and legality of Your Content

We will not access, use, or share Your Content except as needed to operate and improve our services, or as required by law.

8. Intellectual Property

The Empower LO platform, website, branding, workflows, templates, and documentation are our intellectual property (or licensed to us). You may not copy, modify, distribute, or create derivative works from our materials without written permission.

Templates, snapshots, and workflows we provide are licensed for your use within the platform only. They may not be resold or redistributed.

9. Third-Party Services

Our platform is built on and integrates with third-party services, including HighLevel (GoHighLevel). Your use of these services is also subject to their respective terms and conditions.

We are not responsible for the availability, performance, or policies of third-party services. If a third-party provider changes or discontinues their service, it may affect the functionality available to you through Empower LO.

10. Disclaimers

Our services are provided "as is" and "as available." We make no warranties, express or implied, regarding:

• The platform being uninterrupted, error-free, or secure at all times
• The results you'll achieve using our platform
• The accuracy or reliability of any information provided through the platform

We provide marketing tools and automation, not marketing guarantees. Your results depend on how you use the platform, your market, and many other factors outside our control.

11. Limitation of Liability

To the maximum extent permitted by law, Empower LO and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly.

Our total liability for any claim related to our services is limited to the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Empower LO, its owners, employees, and affiliates from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the platform, violation of these terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the platform if you violate these terms, fail to pay, or for any other reason with reasonable notice. Upon termination:

• Your right to use the platform ends immediately
• We may delete your data after a reasonable retention period (typically 30 days)
• Any outstanding fees remain due

You may request an export of your data before termination takes effect by contacting us at support@empowerlo.com.

14. Governing Law

These terms are governed by the laws of the State of Idaho, without regard to conflict of law principles. Any disputes arising from these terms or your use of the platform will be resolved in the courts of Ada County, Idaho.

15. Changes to These Terms

We may update these Terms of Service from time to time. When we make changes, we'll update the "Last Updated" date at the top of this page. Continued use of our services after changes are posted constitutes your acceptance of the updated terms.

For significant changes, we'll make reasonable efforts to notify you via email or through the platform.
